1. Introduction
Welcome to Craftory.lk (hereinafter referred to as "Craftory", "we", "us", or "our"). By accessing or using our website, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.
2. Nature of Services (The "Venue" Clause)
Craftory serves strictly as a technology venue and lead generation platform that connects independent Sri Lankan artisans ("Vendors") with customers ("Buyers").
- Not a Retailer: We are not the manufacturer, seller, or distributor of the goods listed. The contract of sale is strictly between the Buyer and the Vendor.
- Non-Custodial: Craftory does not hold, process, or settle funds for the sale of goods. All payments for products are made directly to the Vendor via Cash on Delivery, Bank Transfer, or the Vendor's personal payment gateway.
- No Fiduciary Duty: We do not act as an agent or fiduciary for any user. We are not responsible for the quality, safety, or legality of the items listed.
3. User Accounts & Security
- Registration: To access certain features, you must create an account. You agree to provide accurate and complete information.
- Vendor Verification (KYC): To register as a Vendor, you must complete a mandatory Identity Verification process. You agree to provide your National Identity Card (NIC) or Driving License details for this purpose.
- Privacy Policy: Craftory retains only your ID Number and contact details for legal compliance. Copies/images of your ID documents are permanently deleted from our servers immediately after verification.
- Security: You are responsible for maintaining the confidentiality of your account credentials. You are liable for all activities that occur under your account.
- Eligibility: You must be at least 18 years old to make a purchase or register as a Vendor.
4. Vendor Obligations & Fees
A. Tier 1: Foundation Sellers (First 100 Verified Vendors)
- Status: Accounts are free of charge ("Lifetime Free Membership").
- Quality Control: Craftory reserves the absolute right to suspend or terminate these accounts without notice if the Vendor remains inactive, fails to process orders, or violates community standards.
B. Tier 2: Standard Sellers (101st Verified Vendor Onwards)
- Subscription: Subject to a monthly subscription fee (Standard: LKR 990 | Premium: LKR 4,990) following a mandatory 1-month trial period.
- Non-Payment: Failure to pay the subscription will result in the immediate hiding (delisting) of the Vendor’s shop and products until payment is cleared.
C. Platform Commission (Global Activation Clause)
- Promotional Waiver: Currently, the Platform Commission Fee is waived (0%) for all vendors.
- Commission Activation: A Standard Platform Fee of 5% per order will automatically become applicable to all sellers once the Platform’s total aggregate sales volume (Gross Merchandise Value) exceeds LKR 100,000.
- Debt Recognition: Since Craftory does not hold transaction funds, this fee is recorded as a "Negative Balance" in the Vendor’s wallet. You acknowledge that this Negative Balance constitutes a legally binding debt owed to Craftory.
- Suspension Limit: If your Negative Balance exceeds -LKR 1,000, your account will be automatically suspended until the debt is settled via Bank Transfer or Payment Gateway.
5. Purchasing, Payments & Logistics
- Direct Payments: Buyers pay Vendors directly via Cash on Delivery (COD), Direct Bank Transfer, or the Vendor’s own payment gateway. Craftory is not a party to these transactions.
- Shipping: Shipping and delivery are the sole responsibility of the Vendor. Delivery timelines displayed on the site are estimates only. Craftory is not liable for delayed, lost, or damaged shipments.
- Order Acceptance: Vendors reserve the right to refuse or cancel any order for reasons including availability or suspected fraud.
6. Returns, Refunds & Disputes
- Vendor Policy: As Craftory does not hold transaction funds, we cannot process refunds. All requests for returns or refunds must be directed to the specific Vendor.
- Dispute Resolution: While Craftory is not a party to the transaction, we may, at our discretion, mediate disputes.
- Fraud Protection: In the event of a dispute involving non-delivery or fraud, Craftory reserves the right to share the Vendor’s KYC details (Name, ID Number, Address) with the Buyer or Law Enforcement Authorities to facilitate legal action.
7. Intellectual Property & Advertising
- Site Content: All content on this site (logos, text, graphics, images) is the property of Craftory.lk or its content suppliers and is protected by Sri Lankan intellectual property laws.
- Vendor Content: By listing products, you grant us a non-exclusive right to use your product images for marketing and promotional purposes.
- Advertising Rights: Craftory reserves the right to display third-party advertisements and "Sponsored/Boosted" product listings on the website, including on search result pages and category pages.
8. Limitation of Liability
To the fullest extent permitted by Sri Lankan law:
- Craftory.lk shall not be liable for any indirect, incidental, or consequential damages arising from the use of our service or the products purchased.
- We bear no liability for the actions or omissions of Vendors, including but not limited to the sale of defective items, failure to deliver, or breach of warranty.
9. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
10. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the site constitutes acceptance of the revised terms.
